In the Dist Court of Fremont County, Iowa , January term 1912, J A Lewis and William Metzger, Plaintiffs vs Lots 2 and 3 in the Northwest Quarter of Section 31 and the South one-half of the Southwest Quarter of Section 30, all in twp 67 Range 42.
Thomas Ripley and the unknown heirs of Thomas Ripley, if he be deceased, and the unknown heirs, devisees, legatees and unknown claimants of the estate of Thomas Ripley and Mrs Ripley, wife of Thomas Ripley, whose first name is unknown, and the unknown heirs of Mrs Ripley, if she be deceased. Susan F Nuckolls, widow of Heath Nuckolls, deceased, Lulu Wesner, J E Wesner, her husband, William S Carey, William B Carey, Constance R Carey, Alice Carey, Abbie Carey, Anna N Carey, Rupert B Nuckolls, Georgia Nuckolls his wife, William Nuckolls, Bruce Nuckolls and the other unknown heris of Heath Nuckolls deceased, and all unknown claimants, legates, assignees or heirs at law of Thomas Ripley, Mrs Ripley, his wife, Heath Nuckolls and Stephen F Nuckolls and all other defendants named above and the unknown spouses of above named defendants.
To the named Defendants:
You and each of you are hereby notified that the petition of the plaintiffs …owners of the South one half of the Southwest quarter of Section 30, Twp 67, Range 42 and Lots 2 and 3 in fractional northwest quarter of Section 31 all in twp 67, Range 42, Fremont County, Iowa. Plaintiffs claim that on the 13«sup»th«/sup» day of February 1861, George F Biggs, trustee, executed a trustee deed for the south one-half of the southwest quarter of Section 30 and the northwest quarter of the northwest quarter of Section 31, all in twp 67 Range 42, to Thomas Ripley. Said northwest quarter of the northwest quarter of Section 31 being also known as Lot 2; said deed herein duly recorded in Book "D" page 269, 270 in the recorder's office in Fremont County, Iowa and on the 11«sup»th«/sup» day of March, 1861 the District Court set said deed aside, all parties interested consenting thereto but the dec- did not describe the land and referred to the description as set forth in the petition in said suit, which has since become lost and cannot be found, and on account of said lost petition, the record title is clouded. That said Thomas Ripley is a non resident of Iowa and it is not known whether he survives and if he is deceased, his heirs are unknown, and it is not known whether of not he left a surviving spouse and if he did , and she has departed this life, it is not known who her heirs are, although diligent search and inquiry has been made, but without avail.
Plaintiffs claim that Heath Nuckolls at one time owned the south one-half of the Southwest quarter section of Section 30, and Lot 2 in Section 31, Twp 67, Range 42, and later conveyed said to Stephen F Nuckolls,, said Heath Nuckolls had his deed recorded in Book "I" Page 524,525 deed records of Fremont County Iowa and when he conveyed said Lot 2 to Stephen F Nuckolls, deed was recorded in Book "S" page 292,293 in Fremont County Iowa, in the recorder's office and it does not appear that Heath Nuckolls conveyed the south one-half of the southwest quarter to Stephen F Nuckolls, but it is believed that he did, and the deed was never placed on record.
Plaintiffs state that Asbury Jacks, one of the plaintiff's grantors had conveyed to him by Stephen F Nuckolls and wife on June 3, 1895, the southeast quarter of the southwest quarter of Section 30, Twp 67 Range 42, and that Heath Nuckolls was aware of said conveyance by his brother, Stephen F Nuckolls, to Asbury Jacks and acquiseed and ---- same and that said Heath Nuckolls departed this life in 1907, left surviving him his widow, Susan F Nuckolls, a daughter Lulu, now the wife of J E Wesner, and the following grandchildren: Constance R Carey, William H Carey, Abbie Carey, Alice Carey and Anna M Carey. Their mother, Anna Nuckolls who intermarried with William B Carey having died prior to the death of her father.
Plaintiffs state that Stephen F Nuckolls deceased, who departed this life in 1870, left surviving him, Rupert Nuckolls, William Nuckolls and Bruce Nuckolls as his sole heirs at law; that said Stephen F Nuckolls in his lifetime had conveyed to him, said Lot 2 in Section 31, Twp 67, Range 42 and from the record it appears he never conveyed same, but said Lot 2 was sold for taxes, tax deed duly executed and delivered to Dexter Reynolds, and recorded in Book "A", page 45,46 of Fremont County Iowa; said Dexter Reynolds taking possession of said land under said deed and is one of plaintiffs grantors herein. Plaintiffs state that they have made due and diligent inquiry as to any other heirs of said Stepehn F Nuckolls and Heath Nuckolls, deceased and their names, if any, and residence, but plaintiffs claim the names and residence of any other heirs than those named, cannot be found.
Plaintiffs claim in their petition that they and their grantors have been in the open, ----, continuous adverse possession of all of said real estate described; for more than ten years to the bringing of this action and asks that the title to said premises herein described be quited in the plaintiff's as against the defendants and all persons claiming by, through, or under them, and for general, equitable relief. And unless you appear thereto and defend before noon of the second day of the next term, being January term of said court, which will commence at Sidney in said county on the - day of January 1912, default will be entered against you and judgment and decree rendered thereon as provided by law.

You and each of you are hereby notified that the petition of the plaintiff is now on file in the office of the Clerk of the Idstrict Court of Fremont County Iowa claiming that he is the absolute owner of the E1-2 of the NE1-4 and the SW1-4 of the NE1-4 and the E1-2 of the NW1-4 of the NE1-4 of Sec 25, Twp 67 R43, Fremount Co, Iowa and that on February 13, 1861, Thomas Ripley obtained title by trustee's deed to the NE1-4 of said section 25 aforesaid which conveyance was set aside by decree of the District Court of Fremont Co, Iowa, the record failing to show service of original notice upon the said Thomas Ripley; that the heirs of Thomas Ripley, also the first name of his wife and her heirs and his heirs, legates and devisees are unknown to plaintiff, after thorough and diligent search therefore: that on January 5, 1874, Stephen F Nuckolls became seized of the title to all of the real estate first above described; that by reason of oversight or neglect, the records of Fremont Co, Iowa do not show conveyance from Stephen F Nuckolls of the SW 1-4 of NE 1-4 of said section 25 aforesaid; but plaintiff avers that said Stephen F Nuckolls prior to January 8, 1882 conveyed same to Heath Nuckolls; that Stephen F Nuckolls and Lucinda, his wife are both deceased; that the defendants Bruce Nuckolls, Rupert B Nuckolls, and William Nuckolls are the sole and olny heris at law of said Stephen F Nuckolls and Lucinda Nuckolls; that because of the aforesaid matters, plaintiffs title to said real estate is clouded, but he avers that he and his grantors have been in the peaceable, open, notorious, adverse possession thereof, under color of title, for more than thirty years; that all right, title or interest of each and all of the defenants is forever barred by the Statute of Limitations and they are forever estopped from asserting any right or title to said real estate, adverse to that of plaintiff and praying a decree quieting title thereto in the plaintiff against all of said defendants and for all just and proper quitable relief. See petition now on file. A Serious charge
Two white men- Oscar Nuckols and S C Nuckols are locked up at the Second Street Police Station on a serious charge. The men are charged with having assaulted and robbed a lady, Mrs A A Keeting on the street yesterday morning in the vicinity of Brook Avenue and Clay Street. A warrant was sworn out by Mrs Keeting and was executed upon the accused by Officer J H Harris, of the Third District. The warrant charges the men with stealing $10. The case will be heard in the Police Court today by Justice Crutchfield

Road Superintendent Nuckols Resigns After Long Service
O N Nuckols for more than sixteen years, superintendent of public roads in Tuckahoe District, Henrico county, has tendered his resignation. He will be succeeded by Mr W V Duval, who will take charge at once. Mr Nuckols is considered the most efficient road superintendent in the county, and resigned the position in the face of much persuasion to the contrary from his friends in Tuckahoe District. He has been in charge since the present system of working the roads was inaugurated.
