This James born 1801-1810. Having 2 sons born 1826-1830 makes him born closer to
1801-1806.
Since William's middle initial was J, probably after his father, and he named
his first born son also James, and the area of location in bordering counties of
settlement, we can probably correctly assume /this James is the father of
William. Possible James Knuckles who married Lydia Rowsey 3/7/1826 in Amherst
Co, VA, able to birth 2 sons before 1830. Amherst Co, VA also bordering
Rockbridge and Allegheney Counties. However this James Nuckols has not yet been
identified.

Hilda Gray Nuckels Richards, 91, of Gatewood, died Nov. 16, 2008, at the Brian
Center Nursing Home, Low Moor, Va. Born June 27, 1917, at Hilltop, she was the
daughter of the late Charles Arthur Nuckels and Macel Buckland Nuckels. She also
was preceded in death by her husband, Arest C. "Trix" Richards in 2000; a
brother, Fred Nuckels; and sisters, Juanita Weddington, Maxine O'Dell and Betty
Fox. Mrs. Richards was a member of the Gatewood Baptist Church, the Order of the
Eastern Star, the Gatewood Mission Circle and the Farm Women's Club.
She had worked as an account collector for the Salem-Gatewood Public Works for
several years. Surviving: her daughter, Kathryn R. Baber of Clifton Forge, Va.;
grandsons, Leonard "Bill" Baber of Winchester, Va., and David Baber of Abingdon,
Va.; granddaughter, Ann Fleenor of Abingdon; great-granddaughter, Sarah Baber of
Winchester; sister, Elizabeth Kearns of South Charleston; and several nieces and
nephews.
Funeral service was Nov. 21 at the Dodd-Payne-Hess Funeral Home Chapel,
Fayetteville, with the Rev. Harry Fuller officiating. Burial followed in Huse
Memorial Park, Fayetteville. Memorials may be made in Hilda Richards' name to

CURETON, J.: Harold Knuckles was charged with driving under the influen ce
(DUI), pled guilty, and was convicted. Knuckles appeals asserting the c ircuit
court lacked subject matter jurisdiction to accept his plea becau se the
indictment charging him with DUI did not contain all of the statuto ry elements
of the offense. We agree and vacate the conviction. (1)
FACTS
On July 17,1998, Trooper Godfrey of the Highway Patrol responded to a traf fic
call from a Metro Narcotics Officer. Upon his arrival at the scene, Go dfrey
encountered Knuckles, performed sobriety tests, and determined Knuck les was
under the influence. Knuckles was arrested and imprisoned for thr ee days.
At his plea hearing, Knuckles requested the court's mercy as he had secur ed a
new job to begin the following week. The court sentenced Knuckl es to one year
imprisonment and fined him $2,000 suspended on time serve d, $1,000 fine and
probation for two years. Knuckles appeals.
LAW/ANALYSIS
Knuckles asserts the circuit court lacked subject matter jurisdiction to a ccept
his guilty plea because the indictment failed to adequately charge h im with DUI
pursuant to section 56-5-2930 of the South Carolina Code. We a gree.
The indictment reads as follows:
That Harold Knuckles, Sr. did in Cherokee County on or about July 17, 199 8,
drive a vehicle while under the influence of intoxicating liquors, and/ or
narcotic drugs, barbiturates, paraldehydes drugs and herbs; such not be ing the
first offense within a period of ten years including and immediate ly preceding
the foregoing date.
The caption of the indictment cited section 56-5-2930, but the section w as not
referenced in the body of the indictment.

Mr. Ralph Boyd Nuckles, 75, passed away Wednesday, Jan. 21, 2004, at Wesley Long
Community Hospital. Mr. Nuckles had surgery on Dec. 15, 2003, followed by a
heart attack, and was in the Intensive Care Unit for 36 days. No formal funeral
service or visitation will be held at this time. A memorial service will be held
at Muirs Chapel United Methodist Church at a later date, and a notice will be
placed in the newspaper. Ralph was born in Greensboro on June 22, 1928, to the
late Durward B. and Hallie Sams Nuckles. He was educated in the Greensboro
public schools. On Oct. 10, 1949, Ralph married Paula Davis of Goldsboro and
they celebrated their 54th wedding anniversary in 2003. Ralph was a quiet,
private person
who loved his family, tinkering around the house, on his car and in the ya d. He
retired in 1994 after 38 1 / 2 years as a printer at Container Corporation of
America (now Jefferson Smurfit Corporation). Ralph enjoyed walking at
Bicentennial Park with Paula and made many friends both human and animal. He
enjoyed sitting on the deck of their house enjoying the sun and the blue sky and
clouds. He was a member of Muirs Chapel United Methodist
Church in Greensboro. Surviving Ralph are his wife of 54 years, Paula Davis
Nuckles; sons, Steve Nuckles and his wife, Peggy, and Daran Nuckles;
half-brother Jerry Varner and his wife, Johnnye; Jerry and Dotties two
daughters, Cindy and Leslie Ann and our special Dottie; sister-in-law Glorida
Davis Roberts and her husband, Tom; nephew Marg Ryan and family; brother-in-law
Charles Dav is Jr.; Uncle Donald Sams and his wife, Hazel, and cousin Louise
Handy Jertson; as well as many friends and former co-workers. Paula and his
family wish to express heartfelt thanks and love to his doctors, Dr. Al Littl e,
Dr. David Newman and Dr. Wert and their associates; all of the nurses a nd staff
of the I.C.U. at Wesley Long Hospital, not only for their excelle nt medical
skills but the love and compassion which meant so much. Our thanks also to

RE: EXIE CROWE NUCKLES AND MARRIAGE TO VIRGIL NUCKLES
Exie and Virgil were married in Lexington, NC; they had a double wedding with
his niece, Nellie. Virgil had a sister Hattie who was the mother of Nellie and
another sister Florrie or maybe Florence (who might have been called Flo). After
their marriage, they lived in Morganton, NC. Virgil had an upholstery shop and
Exie did baby sitting. They then ran a boarding house in Morganton. They sold
the boarding house and rented a house. Next, the moved to Roanoke, VA and bought
a house there. They then sold this house and bought a trailer. Virgil was still
doing upholstery work. Supposedly, they (or Virgil) wanted to look at moving to
Ashville, NC area. Around this time, Virgil took Exie to visit her mother and
family in Lenoir, NC; all she had were the clothes on her back and whatever she
packed in her suitcase. He went back to Roanoke and hooked up the trailer with
all its contents and took off with some woman he apparently had been seeing on
the side; apparently the woman had told him she was pregnant. He was supposed to
pick up Exie and, of course, he never did; when she returned to Roanoke on her
own, she found the trailer and Virgil were gone. This was probably early 1950's.
Apparently, his family did not know where he had gone.
Exie had several miscarriages and, of course, never had any children. It was
said that during their marriage, Virgil had made passes at Doris, who was one of
Exie's younger sisters.
Some 21 years later, Virgil returned to NC and came to see Exie. He had been
living in or near Washington, DC with some lady. He wanted to remarry Exie (she
had obtained her divorce some time after he left). This would be some time in
the 1970's since Exie's mother was still living at the time and very opposed to
Exie having anything to do with Virgil.
They did not marry and did not live together but did keep in touch. Virgil had
TB and EXIE took care of him until his death. He left a Will leaving most of his
assets to EXIE and requested that she send a sum of money to the lady he left
behind in Washington which she did. Apparently, the lady was not too happy with
the sum of money she was left but EXIE gave what the Will directed.Virgil's
mother lived in Winston Salem; sometime after Virgil left, she became ill and
Exie cared for her until her death. Exie went to nursing school after Virgil
left her. She was working for Mrs. Wilson (wife of some of the furniture people
-Bernhardt family) who encouraged her to go into nursing. Anglee Crowe Mandish

My aunt, Exie Crowe Nuckles, deceased 1/31/2004 married Virgil Nuckles. They
lived in a trailer somewhere in VA and when she was visiting her mother he took
the trailer (which had all of her clothing and belongings) and left (sometime in
early 1950's). She got her divorce and became a LPN and supported herself. She
never remarried. Later on around in the early 1980's (I think) he returned to NC
and tried to renew their friendship. She was in touch with him and helped him in
his final illness but they never remarried. They had no children. I believe the
family story is that she helped to also take care of his mother.I believe they
were in VA (not sure) when the trailer incident happened and then he went to the
Washington DC area and lived with some lady for quite a few years and came back
to the Lenoir.Hickory NC area not to many years before he died

A. Nuckols Jr. of Staunton. In addition to her parents, s he was preceded in
death by her husband, Duncan A. Nuckols Sr.; three daughters, Lucillen Kern,
Betty Campbell and Annabelle McCulley; and a numb er of brothers and sisters. A
service will be at 2 p.m. Friday in the chap el of Nicely Funeral Home, Clifton
Forge. Burial will follow at Central Ad vent Christian Cemetery. Visitation will
be from 7 to 8:30 p.m. tonig ht at the funeral home.
