Last Will & Testament of Mary Louisa Nuckolls Thornton

I, Louisa Thornton, being of sound mind and in full possession of my reasoning faculties, do hereby make, publish and declare this my Last Will and Testament hereby revoking all and any Wills heretofore made.

First: I direct my exectors, hereinafter named, to pay my funeral expenses and all my just debts and liabilities as soon as can conveniently be done after my decease;

Second: I give and bequeath to my late daughter, Annie L. Ray's heirs, ($5.00) five dollars in money;

Third: I give and bequeath to Alexander B. Thornton's heirs ($5.00) five dollars in money.

Fourth: I give and bequeath to Nancy C. Martin's heirs (100.00) one hundred dollars;

Fifth: I give and bequeath to my son, John D. Thornton's heirs, ($100.00) one hundred dollars provided she gives to my estate a deed to lands deeded to me by her mother which if she don't do, makes this clause void;

Sixth: I give and bequeath to my sons, P. T. Thornton, I. W. Thornton, and F. L. Thornton, and the heirs of A. N. Thornton, J. D. Thornton and Nancy C. Martin, all the residue or balance of my property of which I am possessed, either personal or real, at my death, to be equally divided between them, provided J. D. Thornton's heir makes the deed above mentioned in fifth clause, but in case she refuses to make said deed, she is to be left out of this clause, and all the rest to be sharers equally. The interest she claims in said land to be all of my estate she is to receive provided she refuses to make the deed mentioned before or after my death.

Eight: I hereby nominate, constitute and appoint my sons, F. L. Thornton and P. T. Thornton executoprs without bond of this my last will and testament.

Signed, sealed, published and declared by the said Testator, Louisa Thornton, as and for her last Will and Testament in the presence of us, who, at her request and in her presence and in the presence of each other, have hereunto subscribed our names as witnesses.

Proof of Will

THE STATE OF ARKANSAS, County of Montgomery.

Personally appeared before me, J.S. Nelson, Clerk of the County and Probate Courts of Montgomery County, aforesaid, P. D. Hawkins and J. W. Rodgers, to me well known, who being duly sworn, say:

That they are the subscribing witnesses to the foregoing instrument of writing purporting to be the Last Will and Testament of Louisa Thornton, late of Montgomery County, deceased; that said instrument was executed at the time, place and by the person therein named; that said Louisa Thornton, the testatrix, was, at the time of signing said instrument upwards of twenty-one years of age and of sound and disposing mind and memory and that in the presence of both of these affiants she declared it to be her Last Will and Testament and subscribed her name thereto in the presence of both of these affiants, that at the request of said Testatrix affiants who wrote their names to her said Will in her presence and in the presence of each other; that the subscriptions to the foregoing instrument of writing are genuine and that said instrument which is hereto attached is the identical one that affiants so witnessed and saw the said Louisa Thornton sign.
