Wm. [William] Pope and wife [Elizabeth Nuckolls Pope], To Deed C. M. [Calvin] Nuckolls [Elizabeth’s brother]

Examined

This Indenture made the 1st day of January in the year of our lord one thousand eight hundred and forty one By and between William Pope and Elizabeth his wife of the County of Wythe and State of Virginia of the one part and Calvin M. Nuckolls of the same (place ?) of the other part witnesseth that the said William Pope and Elizath (sic) his wife for an inconsideration of the sum of one hundred dollars to them in hand paid by the said Calavin (sic) M. Nuckolls at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted barained and sold as by these presents do grant bargain and sell unto the said Calvin M. Nuckolls his heirs and assigns forever a certain tract or parcel of land lying and being in the County of Wythe on the waters of Cripple Creek containing in all one hundred and twelve acres be the same more or less and bound as follows to (wit ?) Beginning at two hickory Saplins north 12 degrees West 210 poles to two Red oaks & white oak saplin north 80 degrees East 62 ½ poles to a black oak Sapling south (14 ? degrees) East 222 poles to a Chesnut tree on the side of the mountain and from thence to the Beginning to have and to hold the said tract or parcel of land together with its appurtenances unto the said Calvin M. Nuckolls and his heirs and assigns forever to the only and proper use and behoof of him the said Calvin M. Nuckolls and his heirs and assigns forever and the said William Pope & Elizabeth his wife do hereby grant for them and their heirs that they and their heirs the said tract or parcel of land and the premices hereby granted or (montened ???—penmanship difficult to read--does not make sense) to be granted and every part or parcel there of with all and (singular ?) their and every of their rights members and appurtenances unto the said Calvin M. Nuckolls his heirs and assigns against them the said William Pope & Elizabeth his wife and their heirs and against all and every other person or persons whatsoever shall and will warrant and forever defend by this presents In witness whereof the said William Pope & Elizabeth his wife have hereunto set their hands and affixed their seals the year first above written

We A. Painter and Wm. (M. or N.) Chatwell two Justices of the peace for the County aforesaid do herby certify that William Pope aparty to a certain deed bearing date on the day of (none given) and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgment to the Clerk of the County Court of Wythe county in order that the said deed may be recorded given under our hands and seals this day of (none given)

Chatwell Justices of the peace from the County aforesaid do hereby certify that Elizabeth [Nuckolls] Pope the wife of William Pope parties to a certain deed bearing date on the (none given) day of (none given) and hereunto annexed personally appeared before us in our County aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her She the said Elizabeth Pope acknowledged the same to be her act and deed and declared that she had willingly signed sealed and delivered the same and that she wished not to retract it Given under our hands and seals the day of (none given)

At a Court held for Wythe County at the Courthouse on Monday the 11th day of January 1841 This deed of bargan and sale was returned to Court and with the certificates of acknowledgment and privy examination annexed ordered to be recorded
